Planning for what will happen to your assets after your death is a task most people avoid. We know there are much more exciting things you could be thinking about and planning for, such as your next holiday or weekend away. However, if you die without a Will your wishes may not be carried out.

The Succession Act sets out what happens to your Estate if you die intestate. Dying without a Will is called ‘dying intestate’ and not only will your Estate be distributed according to the Succession Act, but it creates issues for your family left behind and makes distributing your Estate a far more complicated legal process.

Enduring Power of Attorney

An Enduring Power of Attorney is a document which appoints another person (‘your Attorney’) to make financial decisions on your behalf in the event you lose capacity and cannot make decisions for yourself.

You can choose when you want your Enduring Power of Attorney to commence.

Enduring Guardianship

An Enduring Guardianship is a document which appoints another person (‘your Guardian’) to make health decisions on your behalf in the event you lose capacity and cannot make decisions for yourself.

The appointment of an Enduring Guardian only commences when you lose the capacity to make your own decisions.

Estates

When a person dies, there is a process to be followed in terms of distributing that person’s assets. This area of law is called Estate Law or Succession Law.

Typically, most people have a Will which will set out what happens to their Estate upon their death. Even if someone has a Will, there are still steps that need to be taken to ensure that their wishes are carried out and the law is followed.

This is, of course, a difficult time in people’s lives and dealing with the emotion of someone passing away is hard enough. This is the time when you should ensure you are supported both emotionally and professionally.
